Kepler International LLC is a service-based consulting firm and is fully entitled to compensation for its time, experience, expertise, advisory, consulting, and services. Any fees earned within the scope of services are non-refundable unless explicitly stated otherwise.
Management Fee
The consulting fee is treated as an advance payment and is considered earned upon the provision of services, except in cases where the agreement is terminated for cause, as outlined below:
- If premature termination occurs before full service delivery, a fair calculation will be made based on professional service rates and/or the scope of consulting and services rendered. Any applicable reimbursements and the portion of unearned fees will be settled amicably with the Client.
- If the consulting, advisory, and/or services have been fully rendered, the fee is considered earned, and no refund shall be issued.
In any case where a refund request is made, Kepler International LLC’s strict refund policy applies as follows:
Consulting Fee
The consulting service fee/application fee paid to Kepler International LLC is non-refundable and non-transferable at any time, per the terms of the signed service agreement, including but not limited to situations where:
- The Client voluntarily withdraws/cancels the application for any reason.
- The Client lacks personal interest, patience, or misinterprets the application status.
- There is a failure or delay in providing required documents/information.
- The Client's application is rejected due to incorrect information, security checks, medical reasons, or undisclosed details.
- Unforeseen conditions such as force majeure, war, or acts of God affect the application process.
- The Client breaches any article of the agreement or bypasses Kepler International LLC by making direct contact with third parties.
Application Fee, Government Fee, Due Diligence Fee, and Third-Party Payments
Any government fees, application fees, due diligence fees, attorney fees, vendor payments, or other reimbursable expenses are outside Kepler International LLC’s responsibility. Any refunds related to these payments are subject to the independent policies of the respective entities.
Business Investment and Operational Expenses
All business investments, marketing, HR, IT, payroll, administrative expenses, or any operational costs are considered independent business expenses and are not subject to refund by Kepler International LLC.
Refund Procedures
- Clients must submit refund requests in writing via email or letter, clearly stating the reason.
- Upon receipt, Kepler International LLC will assess the claim based on the refund policy and service agreement.
- If a refund is approved, the Client must sign a settlement agreement.
- All ongoing services/applications will be suspended upon filing a refund request.
- Approved refunds will be processed within 30-45 working days.
Refund Policy Specifics:
- Full refunds will only be issued in cases of technical errors such as double charging or other errors attributable to Kepler International LLC.
- A refund claim is acceptable in cases of service non-performance or incompetency, with fair compensation assessed for time and effort spent.
- Refunds will be processed via the original payment method, bank transfer, or check, if necessary.
- Any success fees, brokerage fees, referral commissions, or repatriation fees earned are non-refundable.
- Any refund request will result in immediate suspension or termination of services.
- Refund requests due to client errors may incur a $350 administrative charge.
Professional Liability Insurance
Kepler International LLC provides professional liability coverage of up to $2 million, ensuring client protection in the event of service deficiencies. Clients may directly file claims with the insurance provider in the event of professional negligence.
Coverage under Professional Liability Insurance includes:
- Errors and omissions: Covers legal costs for professional mistakes or oversights.
- Undelivered services: Protects against claims for incomplete work that disrupts the client's business.
- Negligence accusations: Covers claims if services fail to meet industry standards.
- Missed deadlines: Covers legal costs for lawsuits resulting from project delays.
